What is Mediation?

Mediation is the art of finding common ground.
It is a confidential and impartial process where a neutral third party – the mediator – facilitates communication and negotiation between parties in conflict. Instead of fighting in court, mediation allows for open dialogue, fostering cooperation and creativity to find mutually satisfying solutions.

Discover the Benefits of Mediation:

1. Cost-effective: Tired of draining your profits on legal fees and court expenses? Mediation offers an affordable alternative, significantly reducing the financial burden on your business.
2. Time-efficient: Don't waste months or even years waiting for a court date. Mediation gets you results in a fraction of the time, allowing you to get back to business without unnecessary delays.
3. Preserves relationships: Keep your relationships intact. Mediation focuses on finding win-win solutions, enabling parties to maintain, rebuild, or even improve their business relationships.
4. Flexibility: Unlike rigid court processes, mediation gives you the power to shape your own outcomes. Partner with me to explore creative resolutions tailored to your specific needs.
5. Confidentiality: Worried about sensitive information becoming public? Mediation guarantees confidentiality, safeguarding your sensitive business matters.

How Does Mediation Work?

1. Initial Consultation: Contact CH Mediation Ireland, and we'll schedule an initial confidential consultation.
2. Assessment: As an experienced MII certified mediator, I will evaluate your case, understand the intricacies, and formulate a tailored mediation strategy.
3. Mediation Session: Parties meet with the mediator in a neutral and relaxed environment, sharing their perspectives, identifying common interests, and exploring potential resolutions.
4. Negotiation and Agreement: Guided by the mediator, parties work together to negotiate and reach an agreement that satisfies everyone's needs. The mediator ensures a fair and balanced process throughout.
5. Formalising the Resolution: Once an agreement is reached, I will assist in formalising your resolution, ensuring it's legally binding and enforceable.

The four key benefits of mediation in
resolving conflict and disputes

There are four key reasons to choose a mediation service over traditional legal approaches to dealing with disputes and disagreements
  • Confidential Service from CH Mediation Ireland

    Confidential

Mediation is a confidential process. Your mediator will not disclose any information revealed during the mediation. The sessions are not tape-recorded or transcribed. Unlike court procedure there is no public sharing of your dispute.
  • Solution Focused Service from CH Mediation Ireland

    Solution Focused

The process is informal and flexible; lawyers are not necessary. There are no formal rules of evidence and no witnesses. You and the other party remain in complete control of the process and any agreement you reach.
  • Cost effective Service from CH Mediation Ireland

    Avoids Legitigation Costs

When parties want to get on with their business and their lives, mediation is an option to consider. Mediation generally takes less time to complete, allowing for an earlier solution than is possible through investigation.
  • Impartial Service from CH Mediation Ireland

    Impartial Service

Your mediator is not there to judge or direct you what to do. The mediator will manage the process to ensure all parties are heard and are able to explore the issues and identify solutions in a safe, confidential way.

What is the mediation process ?

Mediation allows for creative outcomes that would not be available through the narrower remit of investigation or litigation.
Request for Mediation
The process typically starts with a request for mediation from one or both parties involved in the conflict.
Understand the issues
The mediator then meets separately with each party to hear their side of the story and understand their perspective.
Finding a solution
The mediator may then bring both parties together where they can share their concerns and work towards finding a mutually acceptable solution.
Agreement document
Where agreement is reached on a resolution - the mediator will produce a document capturing what was agreed for both parties to sign.
